Nature of Services
flybubu provides rental services for cameras and related devices to customers or travelers planning to visit various destinations from Hong Kong. Please note that flybubu does not sell equipment through this website.
Privacy Policy
flybubu.com.hk places a high priority on protecting customers’ privacy, which is fundamental to our business. We collect customers’ personal information solely to the extent necessary to provide our camera and device rental services, including rental processing, promotion, registration, shipment, collection, and management. This information will not be used for any purpose other than those explicitly mentioned above.
Rental Agreement
Article 1: Contracting Parties
This rental agreement is made between the Lender, flybubu.com.hk (hereinafter referred to as “Party A”), and the Lessee (hereinafter referred to as “Party B”). Both parties agree to the rental of related equipment (hereinafter referred to as “Rental Items”) as outlined in this agreement.
Article 2: Rental Items, Duration, and Fees
The Rental Items, accessories, rental period, rental fees, pickup/return methods, and shipping costs are as detailed in the agreement. Upon Party B’s acceptance, this agreement is considered established, and Party B must comply with all terms and conditions of the rental agreement and rental guidelines. Party B must pay the full rental fee and any additional charges at the time of delivery of the Rental Items.
Article 3: Return of Rental Items
Party B must return the Rental Items by the agreed time. Exceptions apply if delays are caused by damage to the Rental Items or force majeure events beyond Party B’s control (e.g., typhoons, earthquakes, floods, or riots). In such cases, Party B must notify Party A immediately. Until the Rental Items are returned, Party B’s rights and obligations remain governed by this agreement.
If the order is canceled, 100% of the rental fee will be charged as a cancellation fee. The deposit will be refunded according to the deposit policy. No refund will be issued for early returns.
Article 4: Extension and Late Returns
- Party B may return the Rental Items early; however, rental fees already paid will not be refunded (except in cases of natural disasters).
- If Party B wishes to extend the rental period, they must contact Party A and obtain approval for the extension.
- For late returns within 10 days, Party B will be charged based on the original daily rental rate.
- If Party B fails to return the Rental Items or pay the outstanding rental fees, Party A has the right to retrieve the Rental Items and claim any associated costs.
- If Party B is uncontactable for three days after the due date, Party A reserves the right to deduct the full value of the Rental Items until the items are returned and all outstanding fees are settled.
Article 5: Obligations of Care
Party B must maintain and care for the Rental Items with due diligence and is prohibited from subleasing, selling, pledging, mortgaging, transferring, or otherwise encumbering the Rental Items. Ownership of the Rental Items and related accessories remains with Party A. This agreement only grants Party B the right to use the items during the agreed rental period without transferring any ownership rights.
Article 6: Damage and Compensation
- If the Rental Items or accessories are lost, damaged, or found to be malfunctioning, Party B must notify Party A immediately.
- If the damage is determined to be caused by negligence, Party A reserves the right to choose between repairing the item or requesting Party B to compensate for the item with a replacement of the same type, quality, and quantity or with equivalent cash value.
- Party B is not Party A’s agent for any purpose during the rental period. Repairs or replacements of any parts or accessories require Party A’s prior approval.
- If the Rental Items cause harm to third parties, Party B must not waive claims against such third parties or take any action detrimental to Party A’s rights. Party B will be held liable for any resulting losses.
Article 7: Rental Guidelines
Additional details regarding responsibilities for loss or damage, transaction details, and other matters are available on the flybubu website. Party B confirms that they have thoroughly reviewed and agreed to the rental guidelines without objection.
Article 8: Entire Agreement
The rental guidelines, reservation forms, and all attached documents are considered an integral part of this agreement and hold equal legal effect.
Article 9: Governing Law and Jurisdiction
Any matters not covered in this agreement will be resolved based on relevant laws, practices, and principles of good faith. Should litigation arise, both parties agree to submit to the jurisdiction of Hong Kong courts.
Article 10: Agreement Effective Date
This agreement takes effect and becomes legally binding once Party B notifies Party A via fax, email, or text message that they have reviewed and agreed to its terms.
DEPOSIT POLICY
Deposit Policy
Upon our receipt of the Equipment following your Return, if there is no outstanding charges, we will refund the deposit to the same credit card/payment channel used when placing the order. If there is any outstanding charges, it will be charged against the deposit: and after deducting all charges. The balance of the deposit will be refunded after 60 working days from the date of Return of the Equipment. The customer has agreed that we can change the method for refunding the deposit to a bank transfer. The customer will need to submit their bank details to us via email as the method for the deposit refund, and they have also agreed to allow us more processing time for the refund. The completion of the entire transaction on their part signifies their acceptance of our terms and conditions for the goods. The deposit policy does not apply to items with no deposit required.
Regarding Shipping
- Due to the high value of electronic products, only SF Express is supported for shipping both ways. Outbound shipping costs will be covered by us, while return shipping costs are the buyer’s responsibility. Buyers can decide whether to purchase shipping insurance. We will consider the return complete once we receive the item in good condition.
- The sender is responsible for the safety of the shipment. If the buyer receives a faulty device, we will provide a replacement or a full refund. However, if the returned item is found to have issues upon receipt, the buyer will be responsible for compensation.
Regarding Cancellations and Modifications
- For order cancellations, 100% of the rental fee will be charged. Deposits will be refunded in accordance with the deposit policy. No refunds will be issued for early returns.
- To extend a rental, customers must contact customer service in advance. The daily rental fee for the extension will be charged based on the original daily rate at the time of the order. If the customer fails to return the items on time and does not contact customer service for an extension, the order will be considered overdue, and double the daily rental fee will be charged.
Regarding Shipping and Returns
- For Buyers: Upon receiving the item, please take photos or videos within 12 hours and send them to customer service for record-keeping. Verify that all accessories are complete and the device is functioning properly. If you do not contact customer service to confirm or report any issues, the item will be considered complete and in good condition by default.
Before returning the item, buyers are required to take photos of the accessories for verification and record a video showing the device functioning properly. Send these records to customer service for confirmation.
Compensation Policy
- For lost equipment or accessories, full compensation for the value of the lost item is required.
- In cases where equipment or accessories are severely damaged and cannot be repaired, the buyer will need to purchase the item at its full value.
- If the equipment or accessories can be repaired, they must be sent to an official service center for repairs. Third-party repairs are not accepted. The buyer will be responsible for covering the official repair costs. (During the repair period, 7 days of rental fees will be waived. If repairs take longer than 7 days, the buyer will be charged for the seller’s loss of rental income.)
- If the equipment or accessories suffer damages such as scratches or dents that result in depreciation, the buyer must compensate the seller for the provided depreciation amount.
Damage Assessment and Compensation Standards
- Lost Equipment and Accessories
In the event of equipment or accessory loss, we will purchase replacements from the second-hand market, and the customer will be required to cover the full cost. Quotations from the seller will be provided to the customer for reference.- Accessories included in the package will also be factored into the total compensation amount.
- Compensation will not exceed HKD 5,000.
- If the deposit paid is insufficient to cover the total amount, the remaining balance must be compensated by the customer.
- Note: Customer identification will be recorded during the rental process. In cases of refusal to compensate, legal action will be pursued.
- Damaged Equipment and Accessories
- Compensation standards follow our damage assessment criteria and insurance guidelines.
- Compensation amounts will be determined based on the chart provided.
- If a deposit was paid, it will be deducted accordingly.
- Note: Customer identification will be recorded during the rental process. In cases of refusal to compensate, legal action will be pursued.
If the equipment is lost, the insurance service does not cover it, and the full value of the item must be paid. The insurance only covers the main device, not the accessories.
